The IPA's Position on the Illinois Supreme Court Community Justice Worker Program

Community Justice Worker ProgramThere is a critical gap in access to justice within Illinois. Whether it is unmet legal needs, a lack of resources, or financial constraints, many Illinoisans struggle to access adequate legal representation. The Illinois Paralegal Association supports the Illinois Supreme Court’s initiative to explore alternative practitioner programs.
 
The Illinois Supreme Court announced that the Executive Committee will work with the Supreme Court Commission and stakeholders to develop a regulatory framework for a Community Justice Worker Program. This program will enable certified non-attorney individuals to provide limited legal assistance in high-need areas under the supervision of an Illinois-licensed attorney. The Executive Committee is to submit final recommendations to the court by October 2026.
 
The paralegal community sees firsthand the need for more legal services available to low-income and rural communities. Several states have enacted various versions of limited legal practitioner programs and have seen wide success. With the creation of a Community Justice Worker Program, this can increase access to legal assistance and improve efficiency of the court processes by offering an alternative legal service and overall, reduce the burden on courts with the current backlog of cases across multiple districts.
 
Paralegals’ roles have expanded greatly over the years. Many paralegals prioritize professional development to stay in touch with today’s ever-changing technology and legal realm. Whether it is drafting a pleading, screening a client, or managing the firm's invoicing, paralegals are the backbone of a successful practice. The Illinois Paralegal Association supports the initiative to offer a Community Justice Worker Program to aid in filling the service gaps in underserved areas, offer cost-effective assistance, and relieve pressure on pro bono and legal aid providers. Paralegals are a natural partner for these alternative service roles. Furthermore, an alternative program will provide opportunities for career growth and recognition for paralegals looking to advance their careers.
 
The Illinois Paralegal Association believes that such a program requires safeguards and ethical considerations. In our own paralegal accreditation program, we ensure rigorous standards are met. The IPA is aware of the fundamental boundary of unauthorized practice of law and condemns such action. We believe the Illinois Supreme Court will provide a clear delineation of the scope for a Community Justice Worker Program with appropriate limits.
 
The Illinois Paralegal Association encourages stakeholders to engage with their legal community in support of a Community Justice Worker Program. The Court’s announcement is a promising path toward increasing access to justice and paralegals statewide are ready to contribute. With strong safeguards, Illinois residents who currently lack legal help can be better served.
